Privacy Policy

1. Introduction

Intellibus Inc. ("Intellibus," "we," "us," or "our") organizes the Intellibus Hackathon (the "Hackathon"), an in-person hackathon event held in Kingston, Jamaica. This Privacy Policy explains how we collect, use, disclose, and protect the personal data of individuals who register for, attend, or otherwise participate in the Hackathon (each, a "Participant," "you," or "your"), and describes your rights under Jamaica's Data Protection Act, 2020 (the "Act").

This Privacy Policy applies to personal data collected through the Hackathon registration portal, at check-in, and during the event.

2. Who We Are

Intellibus Inc. is the data controller responsible for the personal data described in this Policy.

3. Definitions

  • "Personal Data" means any information relating to an identified or identifiable natural person.
  • "Sensitive Personal Data" means personal data revealing matters such as an individual's health condition, religious beliefs, or other data of a similarly sensitive nature.
  • "Data Subject" means the individual to whom personal data relates.
  • "Processing" means any operation performed on personal data, including collection, storage, use, disclosure, or erasure.
  • "Data Controller" and "Data Processor" have the meanings given to them under the Act.

4. Personal Data We Collect

When you register for the Hackathon through our registration portal, we collect the following categories of personal data directly from you:

4.1 Identity and Contact Data

  • Full name
  • Email address
  • Phone number
  • Date of birth
  • Country and parish of residence

4.2 Automatically Collected Data

When you use our registration portal or website, we and our analytics provider, PostHog, automatically collect technical and usage data, including device and browser type, IP address, pages visited, and interaction data, for the purposes described in Section 12.

5. How We Use Your Personal Data

We use the personal data described in Section 4 for the following purposes:

  • Registering, verifying, and managing your participation in the Hackathon
  • Communicating with you regarding event-related announcements;
  • Responding to safety incidents or medical emergencies;
  • Maintaining the security, integrity, and proper functioning of our registration portal;
  • Understanding how our website is used, and improving them, through aggregated analytics; and
  • Complying with our legal obligations and enforcing our Terms and Conditions and Code of Conduct.

6. Legal Basis for Processing

We process your personal data on the following legal bases under the Act:

  • Consent — for registration generally, for Sensitive Personal Data (Section 4.5), for parental/guardian data relating to minors, and for cookies and analytics as described in Section 12;
  • Performance of a contract — to administer your participation in the Hackathon and any prizes awarded to you, in accordance with our Terms and Conditions;
  • Vital interests — to contact your emergency contact or parent/guardian in the event of a medical or safety emergency; and
  • Legitimate interests — to keep our registration portal secure and functioning, and to understand aggregate usage of our website, provided such interests are not overridden by your rights.

7. How We Share Your Personal Data

We do not sell, rent, or share your personal data with third-party sponsors, partner institutions, or other organizations for their own independent purposes. Data collected through the Hackathon registration process is used only by Intellibus for the purposes described in this Policy.

We do disclose personal data to a limited number of service providers who process data strictly on our behalf and under our instructions, namely:

  • Supabase, our database and backend infrastructure provider, which hosts our registration data on infrastructure located in the US West (Oregon) region; and
  • PostHog, our product analytics provider, which processes automatically collected usage data as described in Section 4.6 and Section 12.

We may also disclose personal data where required to do so by law, in connection with a legal process, or to protect the safety of a Participant or others in an emergency.

8. Minors and Parental Consent

Participation in the Hackathon is open to minors (individuals under the age of 18). Where a Participant is a minor, based on the date of birth provided at registration, our registration process requires the collection of a parent or legal guardian's name, phone number, and relationship to the minor, and requires that parent or guardian's consent to the minor's registration, participation, and the processing of the minor's personal data as described in this Policy.

A parent or guardian of a minor Participant may exercise any of the rights described in Section 10 on the minor's behalf by contacting us at jamaica@intellibus.com.

9. International Data Transfers

Because our registration and event infrastructure is hosted on servers located in the United States (via Supabase, in the US West (Oregon) region), your personal data is transferred outside of Jamaica as part of our normal operations.

Under the Act, personal data may not be transferred outside Jamaica unless the receiving territory ensures an adequate level of protection, or a recognized exception applies, such as your consent or the transfer being necessary for the performance of a contract with you. By registering for the Hackathon, you consent to this transfer, which is also necessary for us to perform our obligations to you as a Participant. We additionally require our infrastructure and service providers to maintain appropriate technical and organizational safeguards over any personal data they process on our behalf.

10. Your Rights

Subject to the conditions and exceptions set out in the Act, you have the right to:

  • Be informed about how your personal data is processed;
  • Access a copy of the personal data we hold about you, free of charge;
  • Request correction of inaccurate or incomplete personal data;
  • Request erasure of your personal data in certain circumstances;
  • Object to, or request that we restrict, certain processing of your personal data;
  • Not be subjected to a decision based solely on automated processing that produces legal or similarly significant effects on you;
  • Withdraw your consent at any time, without affecting the lawfulness of processing carried out before withdrawal; and
  • Lodge a complaint with the Office of the Information Commissioner (OIC) if you believe we have processed your personal data unlawfully.

11. Data Retention

We retain your personal data for as long as reasonably necessary to fulfil the purposes described in this Policy, which we anticipate will generally be twenty-four (24) months following the conclusion of the Hackathon for which you registered, unless: (a) a longer retention period is required to resolve a dispute, enforce our agreements, administer a prize, or comply with a legal obligation; or (b) you exercise your right to erasure under Section 10 and no exception described there applies. Emergency contact and parent/guardian data is retained only for as long as needed for the purposes described in Sections 4.3 and 4.4, and in any event no longer than the general retention period above.

12. Cookies and Analytics

Our registration portal and website use cookies and similar tracking technologies operated through PostHog, a product analytics tool, to understand how our site is used and to improve it. This may include information such as your device and browser type, IP address, the pages you visit, and how you interact with our site. You can control or disable cookies through your browser settings, though doing so may affect the functionality of our registration portal.

13. Photographs and Video at the Hackathon

Separately from the personal data described in this Policy, photographs, video, and audio recordings may be captured throughout the Hackathon venue for promotional purposes. This is governed by our separate Media Policy, which addresses your rights, including the ability to opt out of official promotional capture.

14. Data Security

We implement technical and organizational measures designed to protect your personal data against unauthorized access, alteration, disclosure, or destruction, including encryption of data in transit, role-based access controls, and database-level security policies restricting access to registration data to authorized personnel only. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

15. Data Breach Notification

In the event of a security breach affecting your personal data that is likely to result in a risk to your rights and freedoms, we will notify the Office of the Information Commissioner without undue delay and, in any event, within the timeframe required under the Act. Where the breach is likely to result in a high risk to you, we will also notify you directly.

16. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. Any changes will be posted on this page with a revised effective date. Where changes are material, we will use reasonable efforts to notify registered Participants by email.
